El 2 de marzo de 2016, la Intendencia de la Información y Comunicación Zonal 7 Sur, sancionó de oficio a Radio Cariamanga 104.5 FM, de Loja con una multa de USD 3660 por no difundir suficiente música nacional durante el programa “El Show de la mañana”, emitido de 10:00 a 13:00, el 13 de enero de 2016.
Según la Supercom, el medio infringió el artículo 103 de la Ley Orgánica de Comunicación (LOC) en concordancia con el artículo 75 del Reglamento General, el cual establece la obligación de difundir el 50% de contenidos de música nacional. Para esta sanción se tomó en cuenta además la Disposición Transitoria Sexta de la LOC, que en su inciso segundo se refiere a “la gradualidad no solo se aplicará para la producción nacional sino también para la difusión de contenidos musicales en el plazo de tres años a partir de la entrada en vigor de esta Ley, empezando en el 20% en el primer año, 35% en el segundo, 50% en el tercero”.
Durante la audiencia de sustanciación desarrollada el 17 de febrero, Homero Bravo representante del medio argumentó cuestionó que “no existe un método eficaz para determinar el incumplimiento del referido artículo”. Por su parte, el abogado de la Supercom ratificó el reporte interno en el que se alertó que la emisora “durante el programa El Show de la mañana, el 13 de enero de 2016, emitido de 10:00 a 13:00, difundió 35 canciones, de las cuales 32 fueron extranjeras y 3 nacionales, con esto se demostró que el medio de comunicación inobservó el artículo 103”.
A radio station was fined for not complying with the national music fee set by law
On March 2, 2016, the Intendancy of Communication and Information Zone 7 of the Superintendence of Information and Communication (Supercom) charged a fine of USD 3660 to Radio Cariamanga 104.5 FM from Loja for not transmitting enough national music during the program “El Show de la mañana”, broadcasted from 10:00 to 13:00 on January 13, 2016.
According to Supercom, the radio station infringed Article 103 of the Organic Law of Communication (LOC) in accordance with Article 75 of the LOC’s General Regulation, which establishes the obligation of broadcasting 50% of national musical content. Besides, the LOC’s Sixth Transitional Provision, paragraph 2, was also taken into account for this sanction, which refers to “the gradual adjustments that will be applied not only to national production but also to the broadcast of musical contents in a period of three years from the entry into force of this law, starting with 20% in the first year, 35% in the second year and 50% in the third one”.
During the hearing on February 17, Homero Bravo, representative of the radio station, argued that “there is no an effective method in order to determine the breach of that article”. On the other hand, the Supercom’s lawyer ratified the internal report in which it was notified that “the radio station, during the program El Show de la mañana, on January 13, 2016, from 10:00 to 13:00, broadcasted 35 songs, 32 of these were foreign songs and 3 were national; thus, this proved that the radio station infringed Article 103”.
