Diario El Mercurio de Cuenca fue sancionado este 22 de julio con la obligación de publicar dos veces una rectificación y pedir disculpas públicas. La Intendencia de la Información y Comunicación Zonal 6 emitió esa medida administrativa porque el periódico tituló un pedido de rectificación de los ciudadanos Alexandra Toledo y Manuel Gómez Jara, quienes denunciaron al medio por sentirse afectada su honra.
El 1 de junio de 2016, diario El Mercurio, publicó la rectificación a pedido de los denunciantes, bajo el título “Dicen no ser afiliados al Movimiento Alianza País”. Sin embargo, ese titular, a criterio de los denunciantes “afectaría sus derechos a la honra, frente a la ciudadanía, dejando en entredichos su filiación política, pues el titular no fue parte del requerimiento solicitado y señalan que fue una arbitrariedad del medio de comunicación titular su pedido”.
En la resolución, la Supercom determinó que el medio incumplió el artículo 23 de LOC referente al derecho de rectificación y dispuso “que el Director del medio presente por escrito una disculpa pública a los denunciantes y a la ciudadanía, la misma que deberá publicarse en la primera interfaz de la página web del medio denunciado”.
El 15 de julio se desarrolló la audiencia el abogado del medio señaló que “el medio de comunicación cumplió con la solicitud de rectificación y reconoció que titularon dicho pedido, argumentando que el titular fue coherente con el contenido comunicacional”. Por su parte, Gómez Jara, uno de los denunciantes, insistió que “el titular que el Diario colocó en la rectificación no fue parte de su pedido y aseguró que cambió el real sentido del mensaje contenido en la rectificación original, por lo que no se cumplió con lo dispuesto en el artículo 23 de la LOC”.
Citizens feel newspaper affected their honor with "arbitrary" headline stating they are not affiliated with Alianza País
The newspaper El Mercurio from Cuenca was sanctioned on 22 July with the obligation to publish a rectification twice and make a public apology. The Administration of Information and Communication for Zone 6 issued the administrative measure because the newspaper headlined a rectification issued by citizens Alexandra Toledo and Manuel Gómez Jara, who denounced the paper because they felt their honor was affected.
On 1 June 2016, El Mercurio published the rectification requested by the complainants under the headline "They say they are not affiliated to the Alianza Pais Movement". This headline, however, according to the complainants "affected their right to honor before the population, casting serious doubts on their political affiliation, insofar as the headline was not part of the request. They added the media outlet acted arbitrarily when it headlined their rectification".
Supercom determined that the newspaper breached Article 23 of LOC, regarding the right of rectification, and ordered "that the media outlet's director should submit a written public apology to the complainants and the population, which should be published in the first interface of the denounced media outlet's website ".
On July 15, during the hearing before the authorities, the newspaper's lawyer stated that "the media outlet complied with the request for rectification and acknowledged that it headlined this request, arguing that the headline was consistent with the content of the communication". Meanwhile, Gómez Jara, one of the complainants, insisted that "the headline that the newspaper added to the rectification was not part of his request and he claimed it changed the real meaning of the message contained in the original rectification, so that (the newspaper) did not comply with the provisions of Article 23 of the LOC".
