El 3 de Febrero de 2016, la Superintendencia de la Información y Comunicación (Supercom) sancionó a Canal Uno con una multa de USD 3540, equivalente a diez remuneraciones básicas, por incumplir el artículo 32 de la Ley Orgánica de Comunicación, que se refiere a la Protección integral de las niñas, niños y adolescentes, por “revictimizar” a una adolescente, en el programa “En Carne Propia”, transmitido el pasado 28 de noviembre de 2015.
La entidad estatal, que inició el proceso de oficio, determinó que el medio de comunicación incumplió la Ley de Comunicación (LOC) al exponer el entorno familiar de una menor presuntamente violada. Se afirma que el reportaje incurre en “la revictimización así como la difusión de contenidos que vulneren los derechos de los niños, niñas y adolescentes, de acuerdo a lo establecido en el Código de la Niñez y Adolescencia, será sancionada administrativamente”.
El 25 de enero de 2016, durante la audiencia de sustanciación, Verónica Bolaños representante del canal calificó aseguró que “los testimonios presentados fueron de familiares, quienes se enfrentaron entre sí por el caso de la menor de edad” y cuestionó la “intención negativa en contra del medio” ya que a su criterio “en ningún momento se dieron elementos para identificar a la menor, ni en imágenes ni textos”.
Por su parte, el representante de la Supercom reiteró las conclusiones del reporte interno y aseguró que la estación televisiva “creó los mecanismos y condiciones para someter nuevamente a la niña a ese drama del cual habría sido sujeto”. Esta es la segunda sanción del mismo monto que recibe el medio en lo que va del año.
Tv station is sanctioned for the "revictimization of a teenager"
On February 3, 2016, the Superintendency of Information and Communication (Supercom) sanctioned Canal Uno with a fee of 3540 USD, equivalent to ten minimum salaries for not complying Article 32 of the Organic Law of Communication, which makes reference to the integral protection of children and adolescents, for the "revictimization" of a teenager , in the TV program "En Carne Propia " that was aired last November 28, 2015.
The State’s entity determined that the media outlet did not comply the Organic Law of Communication by exposing the family environment of a minor that was allegedly raped . It was stated that the report madre a “revictimization and broadcasting of content that violates the rights of children and teenagers , in accordance with what is established in the Code for Children and Adolescents , shall be punished administratively ."
On January 25, 2016, during the substantiation hearing, Verónica Bolaños , legal representative of the TV station said that "the evidence presented, came from relatives who confronted each other for the case of the minor" and questioned the "negative intention against the TV station because" at her opinion, "no elements were given to identify the minor in images or texts ."
On the other hand the legal representative of Supercom insisted on conclusions of the internal report and stated that the TV station "created the mechanisms and conditions to subdue the child again to the drama of which she would have been subject of." This is the second sanction of the same amount that receives the station so far this year.
