Por la difusión de un programa taurino considerado parte de la cultura “mestiza”, Radio “Quito 760 AM” deberá pagar una multa equivalente al 10% de la facturación promediada de los últimos tres meses. La Supercom concluyó que el medio no difundió el porcentaje mínimo de contenido intercultural, en la programación del 26 de abril de 2016, incumpliendo el artículo 36 de la Ley Orgánica de Comunicación (LOC).
Tras un trámite iniciado de oficio, la entidad reguladora aseguró en su resolución del 8 de julio de 2016 que el medio “no cumplió con el 5% de contenidos interculturales durante el período en el que fue monitoreado”. Respecto al programa “Torerías”, se concluyó que “no cumple con los parámetros de la normativa vigente, es decir referirse a los pueblos y nacionalidades indígenas, afroecuatorianas y montubias, y más bien cubre el ámbito de la cultura mestiza, grupo que ya cuenta con el resto del porcentaje de programación del medio de comunicación”.
El representante del medio de comunicación manifestó durante la audiencia que “el Reporte Interno no tomó en cuenta en el monitoreo del 26 de abril, al programa “Torerías”, que se transmitió de 20H00 a 21H00.” Aseguró que ese espacio “trata sobre el arte taurino, que de por sí es parte de la historia y tradiciones mestizas del Ecuador, lo que comprueba que el contenido es intercultural, por lo que se lo debió considerar dentro de esa clasificación”.
Por su parte, el representante de la Superintendencia afirmó “el incumplimiento de la LOC que tiene como objetivo el reconocimiento de los derechos a la información y comunicación, de los pueblos y nacionalidades indígenas, afroecuatorianas y montubias, hecho que no se comprueba en el contenido del programa al que hizo alusión la abogada del medio”.

After proceedings initiated ex officio, the regulatory entity stated in its resolution of 8 July 2016 that the station "failed to meet the 5% of intercultural content during the period in which it was monitored". Regarding the program "Torerías", it concluded that it "does not meet the parameters of existing legislation, i.e. referring to indigenous peoples and nationalities, Afro-Ecuadorians and Montubios, but rather covers the area of mestizo culture, a group to which the remaining percentage of the media outlet's programming is dedicated".
The radio station's representative said during the hearing that "the Internal Report did not take into account in the monitoring of 26 April, the program "Torerías", which aired from 20H00 to 21H00". He claimed that the program "is about the art of bullfighting, which is part of the mestizo history and traditions of Ecuador, which proves that the content is intercultural, so that it should have been considered within that classification".
Meanwhile, the Superintendency's representative stated it "failed to comply with LOC, which has as an objective the recognition of the rights to information and communication of indigenous peoples and nationalities, Afro-Ecuadorians and Montubios, a fact that is not observed in the content of the program to which the media outlet's lawyer alluded".
