Un mes sin poder ejercer su función de asambleísta y sin derecho a sueldo fue la sanción que le impuso el Consejo de la Administración Legislativa (CAL), a Magali Orellana, legisladora por Pachakutik, por “hacer uso indebido de la palabra”, según lo resolvió este organismo el 25 de mayo.
En un comunicado público, la Asamblea Nacional informó que la sanción a Orellana se produjo por los hechos del pasado 12 de mayo, cuando se debatía la Ley de Solidaridad y de Corresponsabilidad Ciudadana por las Afectaciones del Terremoto en su sesión Nro 387. Según este organismo, ese día la asambleísta protagonizó “incidentes violentos en las sesiones del pleno y maltrató de palabra o de obra a los asambleístas o funcionarios de la Asamblea Nacional, según lo dispuesto en los numerales 3 y 5, respectivamente, del artículo 165 de la Ley Orgánica de la Función Legislativa”. La titular de la Asamblea, Gabriela Rivadeneira, aseguró que “Orellana empujó a una policía, parte de la escolta legislativa, dentro de su necesidad de expresar un show absolutamente mediático y político”.
En diálogo con Fundamedios, la asambleísta Orellana aseguró que se le coartó, no solo su libertad de expresión como legisladora, sino la de su provincia, al no habérsele concedido la palabra durante el debate en el pleno. También afirmó que no es la primera vez ni la única asambleísta a la que se le ha negado la palabra durante el mandato de Rivadeneira.
Al respecto, la legisladora por la provincia amazónica de Orellana comentó que durante el debate se mantuvo alzando la mano y que la presidente de la Asamblea, Gabriela Rivadeneira “se hizo la desentendida”. Fue cuando, al no tener micrófono y al ver que el debate estaba a punto de concluir, que se acercó al estrado. “No me quedó otra alternativa que acercarme y reclamarle a Gabriela Rivadeneira por qué no me daba la palabra. En mi provincia somos enérgicos vigorosos, y esa nuestra forma de decir las cosas, no creo que haya dicho ninguna palabra soez, sino solamente hacer un justo reclamo para que mi provincia sea escuchada”, apuntó la legisladora.
Orellana narró que después de haberse acercado, Rivadeneira le dijo que no le iba a dar la palabra y le pidió, de una forma poco amable, que se retirara. Tras esto, hubo un intercambio de palabras que cesó cuando Rivadeneira mandó a llamar a la escolta para que retuviera a la Asambleísta, mientras ella intentaba liberarse y le pedía que se alejara.
“Cuando Gabriela me dijo: ‘retírate de aquí, ubícate; le respondí: ubicate tu porque tienes que aprender a respetar al país, tu que precisamente eres una mujer que no tiene mérito para estar ahí sentada, eres una inepta”, dijo Orellana.
Al momento la Asambleísta ha acatado la sanción en medio del rechazo de otros legisladores de la oposición, quienes se han pronunciado en su respaldo.
Opposition assemblywoman is suspended for 30 days for calling the President of the Legislative "incompetent"
A month's unpaid suspension from the Assembly was the sanction imposed by the Legislative Administration Council (CAL), to Magali Orellana, legislator for Pachakutik, for "making an improper statement", according to this agency. The ruling was issued on 25 May.
In a public statement, the National Assembly reported that the sanction against Orellana was produced by the events of 12 May, when the Solidarity and Citizen Co-Responsibility for the Effects of the Earthquake Law was being debated during its 387th session. According to this entity, that day the Assemblywoman incurred in "violent incidents in the plenary sessions, including mistreatment by word or deed of the Assembly members or officials of the National Assembly, as described in paragraphs 3 and 5, respectively, of Article 165 of the Organic Law of the Legislative Function". The head of the Assembly, Gabriela Rivadeneira, stated that "Orellana pushed a policeman, part of the legislative guard, in her need to deliver an absolutely political and media spectacle".
Speaking to Fundamedios, Assemblywoman Orellana asserted that not only her freedom of expression as a legislator was restricted, but that of her province, when she was not given the floor during the debate in the plenary. She also stated that she has not been the first nor the only member of the Assembly to whom the floor has been denied during Rivadeneira's mandate.
The legislator for the Amazon province of Orellana commented that during the debate she kept raising her hand but the President of the Assembly, Gabriela Rivadeneira "pretended not to notice". Having no microphone and seeing that the debate was about to end, she approached the stand. "I had no choice but to go over and complain to Gabriela Rivadeneira because she would not give me the floor. We are energetic and vigorous in my province, and that is our way of saying things, I do not think I used any insults, I just complained fairly so that my province would be heard", said the legislator.
Orellana expressed that after she approached the stand, Rivadeneira told her that she could not speak and ordered her to leave. This led to an argument that ceased when Rivadeneira summoned a guard to retain the Assemblywoman, while she tried to free herself and asked him to stay away.
"When Gabriela told me: 'leave, get hold of yourself; I replied: you get hold of yourself because you have to learn to respect the country, especially you who sits there through no merit of your own, you're incompetent", Orellana said.
The Assemblywoman has complied with the sanction amid the rejection of other opposition legislators, who have spoken in her support.
