El periódico “El Despertar Informativo y su Revista” de la localidad costera de Milagro deberá cancelar a la Intendencia de la Información y Comunicación, Zonal 5-8, el equivalente al 10% de la facturación promediada de los últimos tres meses por ausencia de contenido intercultural en su edición No.266 correspondiente a la segunda quincena de mayo de 2016.
En la resolución del 16 de julio de 2016, la entidad reguladora, la cual inició el proceso de oficio, afirmó que el medio incumplió el artículo 36 de la Ley de Comunicación (LOC), que se refiere al derecho a la comunicación intercultural y plurinacional por considerar que “el medio en ninguna de sus páginas publicó información que se enmarque en alguno de los parámetros técnicos que contempla el Reglamento para la aplicación del artículo 36 de la Ley Orgánica de Comunicación sobre Difusión de Contenidos Interculturales, expedido por el Consejo de Regulación y Desarrollo de la Información y Comunicación (Cordicom)”.
El reglamento en mención define a los contenidos interculturales a lo que hace “referencia a la historia de las culturas contadas desde distintas voces, su memoria colectiva y su patrimonio cultural, su creatividad, sus prácticas artísticas y expresiones culturales, saberes ancestrales y, en general, sus formas de ser, estar, saber y hacer en el contexto actual y en el marco de su pasado, presente y futuro…”.
Local newspaper fined 10% of turnover for failing to publish "intercultural content" in one edition
The newspaper "El Despertar Informativo y su Revista" of the coastal town of Milagro, must pay the Administration of Information and Communication for Zones 5-8 the equivalent to 10% of its average turnover for the last three months for lacking intercultural content in its edition No.266 corresponding to the second half of May.
In its resolution of 16 July 2016, the regulatory entity, which initiated the process ex officio, stated that the newspaper breached Article 36 of the Communication Law (LOC), concerning the right to intercultural and plurinational communication, considering that "the media outlet did not publish in any of its pages information that falls within any of the technical parameters included in the Regulation for the application of Article 36 of the Organic Communications Law on the Dissemination of Intercultural Content, issued by the Council for the Regulation and Development of Information and Communication (Cordicom)".
The regulation in question defines intercultural content as that which makes "reference to the history of cultures told from different voices, their collective memory and cultural heritage, their creativity, artistic practices and cultural expressions, their ancestral knowledge and, in general, their ways of being, living, knowing and doing in the current context and in the framework of their past, present and future...".
