Por no difundir información referente a temas interculturales, Radio Caracol FM Stereo 91.3 de la ciudad de Ambato deberá pagar una multa equivalente al 10% de la facturación promedio de los últimos tres meses.
Así lo determinó la Intendencia Zonal 3 de la Información y Comunicación este 8 de junio, tras un proceso iniciado de oficio. La entidad reguladora concluyó que el medio de comunicación incumplió lo establecido en el artículo 36 de la Ley Orgánica de Comunicación, respecto al derecho a la comunicación intercultural y plurinacional, en su emisión del 15 de enero de 2016 de 6h00 a 24h00.
La defensa de la emisora, durante la audiencia ante la Supercom, rechazó el reporte interno manifestando que “los contenidos tienen que promover las comunidades, los pueblos y nacionalidades, la Ley no dice que las radios tienen que producir dichos contenidos porque prácticamente se estaría alterando el sentido virgen intercultural”.
Local radio station must pay 10% of its turnover for failing to release intercultural content
For failing to disseminate information on intercultural topics, Radio Caracol FM Stereo 91.3 of the city of Ambato must pay a fine equivalent to 10% of its average turnover for the last three months.
This was determined by the Intendency of Information and Communication for Zone 3 on 8 June after proceedings initiated ex officio. The regulatory entity ruled that the media outlet failed to comply with Article 36 of the Organic Communication Law (LOC), concerning the right to intercultural and plurinational communication, in its programming of 15 January 2016, between 6h00 and 24h00.
During the hearing before Supercom, the radio station's defense rejected the internal report stating that "the contents must be promoted by the communities, the peoples and nationalities, the law does not say that the radios have to produce such content because this would be altering its virgin intercultural sense".
