El 26 de noviembre de 2014, la Superintendencia de la Información y Comunicación (Supercom) rechazó la impugnación presentada por el periodista Nelson Chacahuasay, propietario del semanario La Verdad de Machala -ciudad ubicada a 500 Km de Quito- después de que el pasado 23 de septiembre, el medio recibiera siete sanciones que suman cerca de USD 8 mil dólares por supuestos incumplimientos a la Ley Orgánica de Comunicación (LOC).
La Supercom consideró “improcedente” la impugnación presentada por el rotativo, el cual corre el riesgo de desaparecer, pues la multa que debería pagar es dos veces mayor al patrimonio del medio de comunicación.
En diálogo con Fundamedios, Chacahuasay cuestionó la decisión de la entidad de control y la calificó de “atrocidad jurídica” porque, según el periodista, quien se desempeña como Intendenta General Jurídica y quien firma la última resolución ratificando la sanción contra el Semanario es la misma abogada que en primera instancia los sancionó.
Al medio se lo sancionó con cinco multas económicas y dos amonestaciones escritas por violentar varios artículos de la LOC. Las sanciones económicas se dieron por supuestamente haber tomado posición institucional respecto de la culpabilidad de personas involucradas en una investigación legal; por supuesta inobservancia al artículo 30, numeral 4 de la LOC referente a la información de circulación restringida acerca de niñas, niños y adolescentes; por supuestamente transgredir el artículo 32 referente a la protección integral de menores de edad, y por supuestamente incumplir con el artículo 60 de la Ley, respecto a la obligación de clasificar contenidos . En tanto, las amonestaciones escritas se dieron por no expedir el Código Deontológico en su portal web y por no respetar los derechos de autor y las normas de citas.
En un diálogo anterior con Fundamedios, Chacahuasay reconoció que, si bien se cometieron algunos errores que ya han sido corregidos, cuestionó que la audiencia de sustanciación se llevó a cabo sin que él pudiera contar con un abogado defensor que tendría que haber sido proporcionado por la Supercom, por lo que no pudo refutar los argumentos expuestos por los abogados de esa entidad. Chacahuasay también cuestionó el monto de la multa que terminaría con su medio de comunicación cuyo patrimonio es menor a USD 4 mil, por lo que ha decidido apelar a esta resolución.
Supercom dismissed the challenge from weekly newspaper which was fined with double of its heritage
On November 26, 2014, the Superintendence of Information and Communication (SuperCom) rejected the challenge filed by journalist Nelson Chacahuasay, owner of the weekly newspaper La Verdad from Machala –which is a city located 500 km from Quito- after the last September 23rd, the media received seven penalties adding a totality around USD $ 8000 for alleged breaches of the Communication Law (LOC).
The SuperCom deemed as "inadmissible" the challenge field by the newspaper, which has the risk of disappearing, since the fine the media should pay is twice of the media assets
Speaking to Fundamedios, Mr. Chacahuasay questioned the decision made by the control entity and called it a "legal atrocity" because, according to the journalist, who works as General Legal Intendant and who sign the final resolution ratifying the sanction against the Weekly newspaper is the same lawyer that sanctioned it in the first instance.
The media was sanctioned with five financial penalties and two written warnings for violating several articles of the LOC. The economic sanctions were given for allegedly taking institutional position on the culpability of people involved in a legal investigation; for presumed breach of Article 30, paragraph 4 of the LOC regarding restricted circulation information about children and adolescents; for allegedly violating Article 32 concerning the comprehensive protection of minors, and for allegedly failing to comply Article 60 of the Law, regarding the obligation to classify content. Meanwhile, the written warnings were given for not issuing the Code of Conduct on its website and for not respecting copyrights and quotation rules.
In a previous dialogue with Fundamedios, Mr. Chacahuasay acknowledged that some errors were done, have been corrected now; He also questioned that the audience of conduct took place even though He didn’t have a defense attorney that should have been provided by the SuperCom, that’s why He could not refute the arguments made by the control entity lawyers. Mr. Chacahuasay also questioned the amount of the fine, which could end his media whose equity is less than USD 4000, for that reason he has decided to appeal this decision.
