El 22 de septiembre de 2014, el Tribunal de la Sala Penal de la Corte Provincial de Pichincha confirmó la sentencia de un año de prisión contra Pablo Chambers y Gerardo Portillo -dos de los cuatro veedores ciudadanos que investigaron los contratos que mantenía el hermano del Presidente de la República con el Estado- tras desestimar los recursos de apelación presentados
El pasado 9 de mayo de este año Chambers y Portillo fueron declarados culpables de haber cometido los delitos de falso testimonio y condenados por el Tribunal Octavo de Garantías Penales de Pichincha. Sin embargo, otros dos miembros de la veeduría fueron absueltos.
En diálogo con Fundamedios, Ramiro Román, abogado de los veedores aseguró que se confirmó la sentencia dictada en primera instancia que condenó a Chambers y Portillo y absolvió a los otros dos veedores José Quishpe y Víctor Hugo Hidalgo. Este punto fue particularmente cuestionado por Román quien considera que existe una contradicción manifiesta. “¿Cómo es posible que el mismo papel sirva para condenar a dos personas y absolver a otras dos? Eso no puede ser, no hay lógica ni congruencia. No existe la motivación suficiente” apuntó el abogado quien aseguró que la ratificación de la condena es una violación al derecho penal y constitucional porque “en los procesos que se están manejando no hay tipos penales, no existe falso testimonio”. A su criterio, no podían haber condenado a sus defendidos ya que la materialidad nunca fue justificada, pues la Fiscalía no recabó la documentación relacionada a las denuncias planteadas en la veeduría.
Este caso se remonta a febrero de 2011, cuando los veedores –elegidos por sorteo por el Consejo de Participación Ciudadana y Control Social para realizar las investigaciones- concluyeron en su informe que el Primer Mandatario conocía acerca de los contratos de su hermano . Afirmaron además que en los procesos hubo preferencias e ilegalidades ocasionando un grave perjuicio al Estado. Con base en la divulgación de estas conclusiones, la Fiscalía pidió que se procese a Pablo Chambers, Gerardo Portillo, José Quishpe y Víctor Hugo Hidalgo, quienes fueron llamados a juicio en septiembre de 2012.
La sentencia absolvió a José Quishpe y Víctor Hugo Hidalgo, dos de los cuatro veedores, no obstante que el informe por el cual fueron acusados tenía la firma de todos los integrantes de la Comisión. Al momento, la defensa de los veedores condenados espera la notificación formal de la sentencia para apelar.

The one year prison sentence against overseers´ citizens is confirmed
On September 22nd, 2014 the Law court of the Criminal Division of Pichincha´s Provincial Court, confirmed the sentence of one year imprisonment against Gerardo Portillo, Paul Chambers -two of the four overseers’ citizens that investigated the contracts that kept the Ecuadorian president's brother with the state- after appeals were filed and rejected.
On the 9th May this year, Chambers and Portillo were found guilty with the crimes of perjury and false testimony; Sentenced by the Eighth Criminal Court of Pichincha. However, two other members of the same oversight group were acquitted.
Speaking to Fundamedios, Ramiro Roman, lawyer of the two sentenced held that the judgment of first instance sentenced Chambers and Portillo and acquitted the other two overseers´ José Quishpe Hidalgo and Victor Hugo. This point was particularly questioned by Román who believes that there is a obvious contradiction. "How can is possible the same paper works to convict two and acquit the other two? That cannot be happening; there is no logic or consistency. There is not enough motivation" said the lawyer who also alleged that the sentence´s ratification is a completly violation of criminal and constitutional law because "the processes that are being handled there aren´t criminal offenses, there is no false testimony". In his opinion, they couldn´t have convicted his defendants because the criminal materiality was never justified, since the prosecution did not seek out the documents related by the complaints raised by the over seekers. This case dates back to February 2011 when the veedores, chosen by lot by the Consejo de Participación Ciudadana y Control Social (Council of Citizen Participation and Social Control) for the research- concluded in their first report that the president knew about his brother's contracts. They stated that the proceedings were unlawful preferences, causing serious damage to the state. Based on the disclosure of these findings; the prosecution asked for an action against Paul Chambers, Gerardo Portillo, José Quishpe and Victor Hugo Hidalgo, who were called to trial in September 2012.
The judicial decision acquitted José Quishpe and Victor Hugo Hidalgo, two of the four veedores, however the report for which they were charged was signed by all the members of the Commission. At the time, the defense of those veedores convicted is waiting for the formal notification of the decision to appeal.
