Radio Fútbol FM 96.9 suma su décima primera sanción después de que la Superintendencia de la Información y Comunicación (Supercom), a través de un proceso iniciado de oficio, multara el 3 de junio pasado al medio con el pago de USD 3.660. El organismo multó al medio por incumplir lo dispuesto en el artículo 65 de la Ley Orgánica de Comunicación (LOC) al difundir contenidos no aptos para el horario y tipo de audiencia en el programa “Hablando jugadas”, transmitido el 31 de marzo de 2016, en el horario de 08:00 a 10:00.
La Superintendencia determinó que “el lenguaje utilizado por los presentadores de la radio no se adecuó a la franja horaria en la que se difundió”. En la resolución se afirma que se constató “la utilización de expresiones como: “somos felices en el chisme”, “denigra y vencerás”, “pegado la cochinada” “yo soy una prostituta del periodismo” “soy un drogadicto reiterado”; y, en toda la trasmisión se aprueba conductas negativas como un hecho positivo (…)”. Al finalizar dicha resolución asegura que “fehacientemente el medio de comunicación social reportado difundió contenido que inobserva los parámetros adecuados para la audiencia y franja horaria en la que se transmitió el programa” .
El 26 de mayo de 2016, durante la audiencia de sustanciación, el representante del medio rechazó el proceso administrativo por considerar que se han encontrado incoherencias en el reporte interno. En ese sentido agregó lo siguiente: “no encontramos sentido en acudir a las audiencias, en dar los argumentos legales de los cuales nos sentimos respaldadas porque realmente no han sido tomados en cuenta ni en los anteriores y menos va a ser tomado en cuenta en esta audiencia”.
Con esta resolución suman once las sanciones dictadas en contra de esta emisora, de las cuales siete han sido por comentarios vertidos por sus locutores, en especial por Luis Miguel Baldeón. Ocho procesos han sido iniciados de oficio y tres por denuncia de Oscar Arma de la Bastida.
Sports radio gets eleventh sanction for "inappropriate comments"
Radio Fútbol FM 96.9 got its eleventh sanction after the Superintendency of Information and Communication (Supercom), through a process initiated ex officio, fined the station USD 3,660 on 3 June. The agency fined the station for failing to comply with the provisions of Article 65 of the Organic Communication Law (LOC) by disseminating content unsuitable for the time slot and the kind of audience during the program "Hablando Jugadas", broadcasted on 31 March 2016 from 08:00 to 10:00.
The Superintendency ruled that "the language used by the announcers was not fit for the time slot in which this content was broadcasted". The resolution states that it verified "the use of expressions such as: "we are happy to gossip", "denigrate and rule", "stuck to filth", "I'm journalism's prostitute", "I am a repeat drug addict"; and that the whole broadcast approves of negative behaviors as positive events (...)". The resolution ends by stating that "the media outlet in question irrefutably disseminated content that fails to comply with the parameters established for the audience and time slot in which the program was broadcasted".
On 26 May 2016, during the substantiation hearing, the radio station's representative rejected the administrative process on the grounds that inconsistencies have been found in the internal report. He also added: "there is no point in attending the hearings, presenting legal arguments which we feel support us because they really have not been taken into account in the past and they will even less be taken into account in this hearing".
This is the eleventh sanction against this station, seven of which have been the result of comments made by its announcers, especially by Luis Miguel Baldeón. Eight of the processes have been initiated ex officio and three have been based on complaints made by Oscar Arma de la Bastida.
