Por no publicar notas interculturales correspondientes al 5% del total de sus contenidos, la Intendencia Zonal 3 de la Información y Comunicación sancionó este 31 de mayo al periódico La Gaceta de Latacunga (sierra central) con una multa equivalente al 10% de la facturación promediada de los últimos tres meses.
La entidad reguladora, que inició el proceso de oficio, concluyó que el medio incumplió lo establecido en el artículo 36 de la Ley Orgánica de Comunicación (LOC), referente al derecho a la comunicación intercultural y plurinacional, en la edición publicada el 21 de enero de 2016. Tal y como lo establece la ley, el medio debió haber destinado un espacio mayor a una página completa a este tipo de contenidos.
Durante la audiencia ante la Supercom el representante del medio rechazó el reporte interno y agregó que “en la referida edición se publicaron varias notas informativas interculturales, que cumplieron con el porcentaje asignado por la Ley”. Además detalló cada una de las notas que “a criterio del medio, fueron consideradas como interculturales”.
Local newspaper fined 10% of its turnover for failing to publish intercultural content
For failing to ensure that 5% of its total content were intercultural articles, the Information and Communication Intendancy for Zone 3 fined on 31 May the newspaper La Gaceta de Latacunga (central highlands) the equivalent to 10% of its average turnover for the last three months. The regulatory entity, which initiated the process ex officio, ruled that the newspaper failed to comply with Article 36 of the Organic Communication Law (LOC), concerning the right to intercultural and plurinational communication, in its edition of 21 January 2016. The newspaper should have destined more than one complete page to this kind of content, as required by law.
During the hearing before Supercom, the media outlet's representative rejected the internal report and added that "there were several intercultural news articles in the edition in question, which met with the percentage assigned by law". He also mentioned each of the articles that "were considered as intercultural by the newspaper".
