El 21 de marzo de 2014, Lucy Blacio, jueza de la Corte Nacional de Justicia emitió las boletas de encarcelamiento contra el asambleísta de Pachakutik, Cléver Jiménez, el periodista y experto en temas petroleros Fernando Villavicencio, y el activista Carlos Figueroa, quienes en abril del 2013 fueron declarados culpables del delito de injurias contra el presidente Rafael Correa.
Justamente fue la jueza Blacio quien sentenció a Jiménez y Villavicencio, en calidad de autores materiales, a 18 meses de prisión, y a Figueroa a seis meses por atenuantes. Esa sentencia se ejecuta una vez q se ha negado el pedido de ampliación y aclaración interpuestos por los sentenciados, el pasado 14 de marzo. Con la orden de encarcelamiento, la Policía Nacional buscará capturar a los tres sentenciados.
En horas de la tarde y tras conocerse la noticia, la agencia de información del Estado Andes publicó en su cuenta de Twitter que el asambleísta Jiménez ya fue capturado. Sin embargo, se conoció que hasta la emisión de esta alerta esto aún no ha ocurrido.
Según una publicación de diario El Universo, en la providencia, la jueza dispuso, en el caso de Jiménez, la suspensión de sus derechos de ciudadanía durante los 18 meses (duración de la sentencia), con lo cual perdería su curul en la Asamblea Nacional .
Hace un mes, la Sala Penal de la Corte Nacional de Justicia compuesta por el juez Vicente Robalino y las juezas Gladys Terán y Mariana Yumbay, negó el recurso de casación al asambleísta y activistas, ratificando así la sentencia emitida por Blacio.
Cabe recordar que el caso se remonta a 2011, cuando Jiménez, Villavicencio y Figueroa pidieron investigar al Presidente Correa por su participación en los hechos del 30 de septiembre del 2010. Esta denuncia fue desechada y calificada de maliciosa y temeraria por el Fiscal, sin que se investigara.
Judge orders prison against Assemblyman, journalist and syndicalist
On March 21st 2014, Lucy Blacio, judge of the National Court of Justice issued a warrant for arrest against the Assemblyman of Pachakutik Cléver Jiménez, the journalist and expert on oil issues Fernando Villavicencio, and the activist Carlos Figueroa, who in April 2013 were convicted of the crime of slander against the President Rafael Correa.
Blacio was the judge who sentenced Jimenez and Villavicencio to 18 months in prison as well as six months to Figueroa. The judgment is executed once the tribunal denied the request for extension and clarification filed on March 14. With the warrant for arrest, the National Police will seek and capture the three convicted.
In the afternoon and after the news became public, the State information Agency, Andes, posted on their Twitter account that the Assemblyman Jimenez was already captured. However, Fundamedios knew that until the issuance of this alert that has not happened yet.
According to El Universo newspaper, the judge decided the suspension of Jiménez citizenship rights for 18 months (length of the sentence). With that, he loses his place in the National Assembly.
A month ago, the Criminal Division of the National Court of Justice, composed by the judges Vicente Robalino, Gladys Terán and Mariana Yumbay denied the appeal made by the defense of the Assemblyman and the activists, confirming Blacio’s judgment.
It is good to remember that the case started in 2011, when Jimenez, Villavicencio and Figueroa asked the authorities to investigate the President Correa for his involvement in the events of September 30th, 2010. The complaint was discarded and after that was qualified as malicious and reckless by the Prosecutor, without being investigated.
