El servidor que aloja al portal de investigación FocusEcuador recibió dos reclamos por supuesta violación a los derechos de Copyright por parte de la Secretaría de Comunicación (SECOM) y el movimiento político oficialista Alianza PAÍS. Recibió otro además, por supuestas calumnias, por parte del fiscal general Galo Chiriboga, representado por la empresa española Ares Rights. Estos reclamos se suman a los recibidos la semana pasada, cuando la misma SECOM y Alianza PAÍS presentaron quejas contra este mismo portal por el supuesto uso ilegítimo de varias imágenes del Primer Mandatario.
En el reclamo presentado por el fiscal Chiriboga, con fecha del 17 de mayo, se pide al servidor que aloja FocusEcuador, la suspensión del sitio por “reincidente”. El documento firmado por Luis Martínez, representante de Ares Rights, señala que “el usuario publica unas urls en las que se calumnia a mi representado, acompañándolo de una imagen creada con el único fin de atentar contra su honor”. El documento también asegura que “la acusación pública sin pruebas fehacientes, es un acto punible conforme al ordenamiento jurídico en Ecuador y cita el Código Orgánico Integral Penal del Ecuatoriano”.
El reclamo hace referencia a fotografías y un texto publicado en la nota titulada “Galo Chiriboga robó la casa de mi familia”, que da cuenta del testimonio de Bárbara Heidinger, quien denunció desde algún lugar de Europa y a través de un video, que el actual fiscal le despojó de su vivienda. Este caso se hizo público tras la revelación de los Panama Papers.
En tanto, ese mismo día se conoció del reclamo planteado por la SECOM, que denunció la supuesta “existencia de archivos en sus servidores que violan nuestros derechos”, por el uso de fotografías e imágenes y del reclamo presentado por el partido oficialista Alianza PAÍS y su secretaria ejecutiva, Doris Soliz, quien el 18 de mayo denunció que el portal ha utilizado “imágenes exclusivas de nuestra propiedad, editadas y transformadas por su cliente sin autorización”.
Al momento, el portal se encuentra al aire, pero preocupa que este podría ser dado de baja en cualquier momento. La semana pasada, Fundamedios y cinco portales digitales de Ecuador denunciaron, en rueda de prensa, “una política de acoso y censura” por parte del Gobierno ecuatoriano contra medios digitales así como a los usuarios de las redes sociales Facebook y Twitter. Fue el caso de Plan V, Mil Hojas, Focus Ecuador, 4 Pelagatos y Ecuador en vivo, quienes han sido víctimas de ataques cibernéticos del tipo DDOs y reclamos de copyright.
Government makes three more complaints in order to disable investigation portal Focus Ecuador
The server that hosts the investigation portal FocusEcuador received two complaints for alleged violation of copyright by the Communication Secretariat (SECOM) and the ruling party movement Alianza PAÍS. It received another one for alleged slander from Attorney General Galo Chiriboga, represented by the Spanish company Ares Rights. These complaints are in addition to those received last week, when the same SECOM and Alianza PAÍS filed complaints against this same portal for the alleged illegal use of multiple images of the president.
In the complaint sent by Attorney General Chiriboga, dated 17 May, the server that hosts FocusEcuador is requested to suspend the site for being a "repeat offender". The document signed by Luis Martinez, representing Ares Rights, states that "the user posts urls in which my client is slandered, accompanied by an image created with the sole purpose of attacking his honor". The document also states that "public accusations without hard evidence are punishable under the law in Ecuador", and it quotes the Ecuadorian Organic Penal Code.
The complaint refers to photographs and a text published in the note titled "Galo Chiriboga stole my family's home", which includes the testimony of Bárbara Heidinger, who denounced from somewhere in Europe and through a video, that the current attorney general dispossessed her of her home. This case became public after the disclosure of the Panama Papers.
Meanwhile, that same day the complaint made by SECOM was made known. SECOM denounced the alleged "existence of files on your servers that violate our rights", based on the use of images and photographs and the complaint lodged by the ruling party Alianza PAÍS and its executive secretary, Doris Soliz, who on 18 May reported that the site had used "exclusive images owned by us, edited and transformed by your client without authorization".
So far the portal is still on the air, but there is concern that it could be disabled at any time. Last week, Fundamedios and five Ecuadorian digital portals denounced in a press conference "a policy of harassment and censorship" by the Ecuadorian government against digital media and the users of social networks Facebook and Twitter. This was the case of Plan V,Mil Hojas, Focus Ecuador, 4 Pelagatos and Ecuador en Vivo , which have been victims of DDOs cyber attacks and copyright complaints.
