Dos estaciones de radio de la ciudad de Ambato fueron sancionadas este 9 de junio por la Intendencia Zonal 3 de la Información y Comunicación tras procesos iniciados de oficio.
La multa más alta fue para radio “Turbo” 93.3 FM, que deberá pagar la suma de USD 3660 por infringir el artículo 103 de la Ley Orgánica de Comunicación (LOC), en concordancia con el artículo 75 del Reglamento General, al no difundir contenidos musicales producidos, compuestos o ejecutados en el Ecuador por un 35% de su programación el pasado 6 de abril, en el programa “Onda Positiva” de 9h00 a 13h00.
La Supercom determinó que “la emisora difundió un 15% de contenidos musicales de origen ecuatoriano al haber difundido 40 canciones de origen extranjero y siete de artistas nacionales.” Durante la audiencia ante la Supercom, el representante del medio reconoció “el cometimiento de la infracción de forma libre y voluntaria”.
La segunda emisora sancionada por esta Intendencia fue la radio “Paz y Bien” 104.5 FM, por incumplir el artículo 60 de la Ley Orgánica de Comunicación (LOC) al no clasificar el tipo de contenido transmitido de 18h05 a 19h53 en el programa “Archivo 104.5”, del 27 de abril de 2016. La radio deberá pagar el equivalente a un salario básico, USD 366 dólares. La defensa del medio de comunicación reconoció, durante la audiencia de sustanciación, la omisión en la que incurrió al no haber identificado, ni clasificado el contenido comunicacional del programa.
Two local stations are fined for failing to disseminate enough national music and for not classifying its content
Two radio stations in the city of Ambato were fined on 9 June by the Intendency of Information and Communication for Zone 3 after proceedings initiated ex officio. The highest fine went to radio station "Turbo" 93.3 FM, which must pay USD 3,660 for violating Article 103 of the Organic Communication Law (LOC), in accordance with Article 75 of its General Regulations, by failing to disseminate music produced, composed or executed in Ecuador as 35% of its programming on 6 April during the program "Onda Positiva" broadcasted from 9h00 to 13h00.
Supercom determined that "only 15% of the music broadcasted by the radio station originated in Ecuador, as it played 40 songs of foreign origin and seven by national artists". During the hearing before Supercom, the radio station's representative acknowledged "they had committed the offense freely and voluntarily".
The second station sanctioned by this Intendency was radio station "Paz y Bien" 104.5 FM, for violating Article 60 of the Organic Communication Law (LOC) by failing to classify the type of content transmitted from 18h05 to 19h53 during the program "Archivo 104.5" of 27 April 2016. The radio must pay the equivalent of a minimum wage, USD 366. The radio station's defense acknowledged during the substantiation hearing, the omission in which it incurred by failing to identify or classify the program's content.
