El 4 de diciembre de 2014, la Superintendencia de la Información y Comunicación (Supercom) sancionó a diario La Hora con una amonestación escrita, tras el inicio de un proceso de oficio, por la publicación de una nota referente al proceso judicial abreviado al que se acogieron varios estudiantes detenidos en las últimas protestas contra el gobierno.
Según la resolución emitida por la Supercom, el medio de comunicación inobservó las normas deontológicas del artículo 10, numeral 3, literal a); y 4, literal e) de la Ley Orgánica de Comunicación, referentes a la obligación de los medios de respetar los preceptos de contextualización y contrastación en la difusión de información de relevancia pública o interés general; así como la obligación de cuidar que los titulares sean coherentes y consistentes con el contenido de las noticias.
A criterio de la entidad de control, en la nota periodística titulada: “Se declaran culpables solo para recuperar su libertad” del 4 de octubre, el periódico “publicó exclusivamente el criterio de lo que el medio considera que sucedió en el proceso judicial para la obtención de la libertad de los detenidos, más no se tomó en cuenta lo que la Ley establece al respecto” y además, “no cuidó que los titulares publicados fueran coherentes con el contenido de esas noticias”.
En la audiencia de sustanciación desarrollada el pasado 28 de noviembre, la defensa del rotativo cuestionó la supuesta inconsistencia de los titulares y alegó que existe armonía entre el titular y desarrollo de la nota. En otro punto, el abogado del rotativo añadió que dentro de la noticia se presentaron varias versiones, entre las que constaba, las de familiares de los detenidos, quienes mencionaron que se estaría obligando al procesado a autoinculparse de un delito que no cometió con el único fin de lograr su libertad .
Cabe resaltar que la Supercom inició este proceso de oficio, tras unas declaraciones que dio el presidente Rafael Correa en su Enlace Ciudadano N° 394, del pasado 11 de octubre, en donde dijo lo siguiente: “¿Si me está escuchando Justicia? yo creo que debe haber alguna consecuencia para este pasquín diario La Hora. Que los chicos se inculparon para salir libres esto es algo gravísimo. En verdad debe haber alguna consecuencia (…) Es una acusación muy grave”, sentenció.
Newspaper is sanctioned for given information of a legal process against students
On December 4, 2014, the Superintendence of Information and Communication (SuperCom) sanctioned newspaper La Hora with a written reprimand after initiated exofficio proceedings, for the publication of a note concerning the abbreviated trial where several students were detained in recent protests against the government.
According to the resolution issued by the SuperCom, the media did not comply ethical standards of Article 10, paragraph 3, subparagraph a); and Article 4 subparagraph e) of the Communications Law, concerning the obligation of the media to respect the rules of contextualization and contrast on the dissemination of information that have public importance or general interest; also have the obligation to ensure the headline news are coherent and consistent with the content of the news.
A criterion of the control entity, in the note entitled "Declare guilty only to regain their freedom" of October 4, the newspaper "published only the criterion of what the media believed that happened in the judicial process for the release of the detainees, most did not take into account what the law states about it" and also "did not caution that published headlines were consistent with the content of the entire news ".
At the hearing of conduct that took place last November 28th, the newspaper defense questioned the alleged inconsistency of the headlines and claimed that there is harmony between the news headline and the development of the note. In another point of view, the lawyer said that inside the mentioned news several versions were presented, among which were versions, presented from the detainees relatives, who mentioned that the students have been forced to confess a crime they did not commit with the only achieve to gain back their freedom.
Is necessary to point that the SuperCom officially began this process, after a statement given by President Rafael Correa in his Citizen broadcast N ° 394, last October 11, where he said: "Is the Justice listening to me? I think there should be some consequence for this tabloid newspaper La Hora. That the boys incriminated their selves to go free this is something serious. It really should be some consequence (...) It's a very serious charge", the President said.
