La madrugada de hoy, sábado 09 de julio, cerca de 70 ciudadanos cubanos fueron trasladados del sitio donde permanecían detenidos desde la madrugada del 06 de julio, de ellos 35 habrían sido deportados hacia Cuba. Así lo denunció Juan Pablo Albán, abogado de los detenidos. Para el experto desde el punto de vista jurídico este acto es “una desaparición forzada” y anunció que solicitarán medidas cautelares a la Comisión Interamericana de Derechos Humanos y presentarán una acción de Hábeas Corpus por los ciudadanos cubanos que aún se encuentran detenidos.
Según Francisco Hurtado, otro de los abogados de los detenidos, 35 ciudadanos cubanos estarían aún en el aeropuerto. Desconoce si salieron más vuelos. Hurtado confirmó que las audiencias de deportación terminaron y trasladarán a 33 personas más al aeropuerto. Aseguró que aún no se han emitido resoluciones de libertad de deportación y que los jueces se pronunciarán dentro de 48 horas. Mostró su preocupación en el sentido de que la tarde o noche de hoy se repitan nuevos hechos como los sucedidos en horas de la madrugada.
En diálogo con Fundamedios, Albán explicó que el jefe de Migración del Aeropuerto Mariscal Sucre en Quito le confirmó que, alrededor de las 06:00, 29 personas fueron subidas a un avión, sin embargo aún se desconocen los nombres y paradero de todos los cubanos trasladados irregularmente del centro de detención.
El abogado explicó además que luego de la audiencia de ayer aún no habían sido notificados con ninguna resolución. No obstante, la Coordinadora de la Unidad Judicial le confirmó que sí se emitieron resoluciones, pero que estas fueron negando deportaciones.
El experto en Derechos Humanos cuestionó el hecho de que las autoridades hasta el momento no se hayan pronunciado al. Hace poco en rueda de prensa Albán exigió al ministro del Interior, José Serrano, y al Presidente Rafael Correa que indiquen el paradero de los ciudadanos cubanos que se encontraban en custodia estatal.
Los ciudadanos cubanos permanecieron una semana de acampada ante la embajada mexicana en Quito, luego fueron desalojados a finales de junio por las fuerzas de seguridad. Posteriormente, se apostaron en el parque La Carolina y finalmente al parque El Arbolito de donde fueron retirados violentamente y luego aprehendidos, pese a que contaban con permisos municipales para ocupar esos espacios. Ellos iniciaron esta acción colectiva con el fin de conseguir una visa humanitaria para garantizar su paso seguro hacia los Estados Unidos.
Dozens of Cubans were deported, lawyers claim it was an irregular process
Early on Saturday 9 July, about 70 Cuban citizens were transferred from where they had been held since the morning of 6 July. 35 of them were allegedly deported to Cuba. This was denounced by Juan Pablo Albán, a lawyer for the detainees. The expert believes that from a legal standpoint this act amounts to a "forced disappearance". He announced that they will seek precautionary measures from the Inter-American Commission on Human Rights and file a writ of Habeas Corpus for the Cuban citizens who are still detained.
According to Francisco Hurtado, another of the detainees’ attorneys, 35 Cuban citizens are allegedly still at the airport. It is unknown if more flights left. Hurtado confirmed that the deportation hearings ended and 33 more people will be moved to the airport. He stated that freedom of deportation resolutions have still not been issued and that the judges will decide within 48 hours. He expressed concern that events like those of the morning may be repeated in the afternoon or evening.
Speaking with Fundamedios, Albán explained that the head of Migration at Mariscal Sucre Airport in Quito confirmed that around 06:00, 29 people were put on a plane. The names and whereabouts of all the Cuban citizens irregularly transferred from the detention center are still unknown.
The lawyer further said that they had not yet been notified about any resolution after the previous day's hearing. However, the Coordinator of the Judicial Unit confirmed that other resolutions rejecting deportations were issued.
The Human Rights expert questioned the fact that the authorities have so far not made a statement. Recently at a press conference, Albán demanded that Interior Minister José Serrano and President Rafael Correa should reveal the whereabouts of the Cuban citizens who were in State custody.
The Cuban citizens camped for a week before the Mexican embassy in Quito, after which they were evicted in late June by security forces. They were stationed later at La Carolina park and finally at El Arbolito park from where they were violently removed and then arrested, despite they had a permit from the Municipality of Quito to occupy that space. They initiated a collective action in order to get a humanitarian visa to ensure their safe passage to the United States.
