El 05 de noviembre de 20114, la Superintendencia de la Información y Comunicación (Supercom) admitió a trámite la denuncia presentada por integrantes de varias organizaciones afroecuatorianas en contra del caricaturista Xavier Bonilla (Bonil) y diario El Universo por una caricatura. Los denunciantes argumentaron la “difusión de mensajes que constituyen apología de la discriminación e incitación a la realización de prácticas o actos violentos”.
La Supercom remitió la denuncia al Consejo de Regulación y Desarrollo de la Información y Comunicación (Cordicom) para que en 30 días resuelva si el contenido de dicha caricatura es discriminatorio.
La acusación se originó por una caricatura de Bonil, publicada el 5 de agosto en diario El Universo. Allí el caricaturista graficó al exfutbolista y actual asambleísta Agustín Delgado, tras un discurso que dio el legislador en la Asamblea y que fue blanco de críticas y burlas en las redes sociales. En la pieza gráfica, Bonil usó la fotografía del legislador en dos escenas. En la primera gráfica se colocó el texto: “COM.. CON…M… MI DIII..SCURSO TODOS DICCEN «POBRE TIN POBRE TIN». En la segunda imagen de izquierda a derecha, se lo muestra con este texto: «¡PERO CON MI SUELDO DE ASAMBLEÍSTA YA NADIE DICE «POBRETÓN POBRETÓN».
A juicio de los denunciantes esta caricatura viola lo establecido en los artículos 61 de Ley Orgánica de Comunicación que habla sobre la difusión de contenidos discriminatorios. En la denuncia aseguraron que “de ningún modo es una caricatura con imagen exagerada o distorsionada, pues claramente se observa dos fotografías del Asambleísta Agustín Delgado; en una leyendo y en otra hablando en micrófono; haciendo constar textos que incitaron a la población a expresarse en forma exacerbada acerca de una persona que pertenece al pueblo afroecuatoriano; provocando e incitando a actos de discriminación en contra de quienes conformamos dicha colectividad”.
Los representantes de los pueblos afros afirmaron que en la caricatura “se hizo burla de la etnia y condición socioeconómica de un integrante del colectivo afroecuatoriano, que como muchos de nosotros, pese a las restricciones que por nuestra etnia nos hemos encontrado en el camino; con esfuerzo y sacrificio, ha ido labrando un futuro mejor para él y su familia; sin que la condición socio-económica que tenía antes de ostentar el cargo de Asambleísta, ni el color de su piel, sea un motivo para ser discriminado… ”
El 07 de agosto, desde su cuenta oficial de Twitter, Bonil, ofreció disculpas al Asambleísta y a su familia por la caricatura, pues horas antes Delgado expresó su molestia por la caricatura.
El 9 de agosto de 2014, el presidente Rafael Correa, durante su Enlace Ciudadano N° 385 descalificó al caricaturista por dicha publicación y lo acusó de “racista”, “politiquero”. El Mandatario también desacreditó a diario El Universo y pidió a la gente rebelarse en contra de la “prensa corrupta”
New legal process against cartoonist, this time for discriminatory content
On November 5th 2014, the Superintendence of Information and Communication (Supercom) admitted the complaint issued by members of several Afro-Ecuadorian organizations against the cartoonist Xavier Bonilla (Bonil) and “El Universo” because of a published cartoon. The complainants argued about the «dissemination of messages that constitute support of discrimination and incitement to the experiments or practice of violence».
The Supercom referred the complaint to the Council for the Regulation and Development of Information and Communication (Cordicom) to resolve within a period of 30 days whether the content of this cartoon is discriminatory or not.
The charge was originated because of Bonil’s caricature, published August 5th at the newspaper El Universo. The cartoonist drawn the former soccer player and current assemblyman Agustin Delgado, after a speech made by the legislator in the Assembly and it was the target of criticism and jokes in social networks. In the graphic piece, Bonil used a photography of Delgado divided in two scenes. In the first graphic the text is placed: «WIT … WITH … .. WITH MY SPE..EECH EVERYBODY SAAYS» POOR POOR TIN». In the second graphic from left to right, it’s shown with this text: «BUT WITH MY ASSEMBLYMAN SALARY .. NOBODY SAYS» POOR POOR TIN ANYMORE». Verito no se si le quieres poner esto en español aun lado para q se vea el sentido del probre tin y pobre ton (“COM.. According to the complainants this cartoon violates the provisions of Article 61 of the Communications Law which is about dissemination of discriminatory content. In the complaint was assured that «in no way is a caricature with exaggerated or distorted picture, it is clearly two photographs of the assemblyman Agustin Delgado; in the first one is reading and in the second picture is speaking on microphone; stating texts that incited the population to expressed in a exacerbated way about a person who belongs to the Afro-Ecuadorian community; provoking and inciting acts of discrimination against those who are part of this community». The representatives of the afro-ecuadorian people said that in the cartoon «was made fun of the ethnicity and socioeconomic status of a member of the Afro-Ecuadorian group, which like many of us, despite our ethnicity constraints we have encountered along the way; with effort and sacrifice, Mr. Delgado has been carving a better future for himself and his family; without the socio-economic status he had before holding the office of Assemblyman, nor the color of his skin, is a reason to be discriminated… «
On August 7th, from his official Twitter account, Bonil, offered an apology to the Assemblyman and his family for the cartoon, since hours before Mr. Delgado expressed anger over the caricature.
On August 9 2014, President Rafael Correa, during his citizen broadcast No. 385 disqualified the cartoonist for the mentioned publication and accused him of «racist», «politician». The president also discredited the newspaper El Universo and asked the people to rebel against the «corrupt press».
